TikTok is facing a ban in the United States, but they are going to fight for their position

It is official: after months of speculation, doubt, and rumors, U.S. courts have finally approved the law requiring TikTok to sell its assets or face a ban in 2025. This decision comes after three judges in Washington, D.C., denied the app’s petition to review the law mandating its separation from its Chinese parent company. The decisive date will arrive on January 19, 2025, by which ByteDance must sell TikTok to a non-Chinese company, or the app will face a complete ban in the United States, where it has 170 million users.

TikTok faces a ban in the United States

Since early 2024, TikTok has been navigating uncertain waters in the U.S. In April of that year, outgoing President Joe Biden announced that the platform would no longer be available in app stores or on hosting sites unless it agreed to separate from ByteDance. TikTok appealed this decision, arguing that the law violated the First Amendment and that divesting from ByteDance was neither legally nor commercially feasible. However, government institutions rejected the appeal, and all signs point toward a complete ban.

The Supreme Court has a historic record of protecting Americans’ right to free speech, and we hope they will do so in this institutional matter as well. Unfortunately, the ban on TikTok was conceived and encouraged based on incorrect, flawed, and hypothetical information, resulting in complete censorship of the American people. Unless stopped, the ban will silence the voices of over 170 million Americans in the country and worldwide on January 19, 2025,stated Michael Hughes, a spokesperson for the company.

Although this resolution has not been fully finalized, the United States could soon join a list of countries that have restricted or banned the use of the short-video app. According to political leaders, the platform allows the Chinese government to collect information and spy on millions of users, as well as serve as a conduit for official propaganda, exacerbating political tensions between the two powers.

The decision could take an unexpected turn, as the Supreme Court could still review the case. Additionally, Donald Trump’s stance, as someone who previously attempted to ban TikTok during his administration, may influence future developments.

TikTok Appeals to Avoid “Sale or Ban” in the United States

The Chinese company has filed an emergency motion with the U.S. Court of Appeals for the District of Columbia. This request seeks to temporarily block the implementation of the law while the case is reviewed by the Supreme Court.

However, ByteDance’s attorneys argue that there is a significant likelihood that the Supreme Court will accept the case and overturn the decision, thus justifying a temporary pause in enforcing the measure.

The case is also influenced by the imminent change in administration. While outgoing President Joe Biden signed measures that restrict TikTok’s operations, elected President Donald Trump has promised to prevent the ban, arguing that the platform is crucial to free speech. This shift could alter the course of the case, as Trump will assume office just one day after the current deadline, on January 20, 2025.

The Department of Justice has not issued any comments on the matter, and TikTok’s future now depends on whether Biden extends the deadline by 90 days—a decision that would require ByteDance to show significant progress toward divesting from the company. Meanwhile, Trump’s arrival could shift the government’s stance toward the app.
